Terms of Service

1. Provider and Scope
These Terms govern your use of FlightCockpit — the website flightcockpit.app, the FlightCockpit desktop application, and the FlightCockpit mobile application (together, the “Service”) — provided by Bashrat Ali Iqbal, trading as Batooldev.com, Germany (“we”, “us”). Full contact details: Impressum. The installation and use of the desktop software is additionally governed by its End User License Agreement (EULA), shown during installation. These Terms are directed at consumers; they apply worldwide.
2. The Service
FlightCockpit streams live telemetry from Microsoft Flight Simulator on your PC to a companion app on your phone or tablet over your local network. It requires a FlightCockpit account, a Windows PC running Microsoft Flight Simulator, and a compatible mobile device. FlightCockpit is a fan-made companion tool for flight simulation; it is not affiliated with or endorsed by Microsoft, and it must not be used for real-world aviation or any safety-critical purpose.
3. Account
You need an account to use the Service. You must provide accurate information, keep your credentials confidential, and be legally capable of entering into this agreement. You can delete your account at any time from your account page; deletion ends these Terms (Section 12 applies to paid periods already started).
4. Plans; Beta
FlightCockpit offers a Free plan and a paid Pilot subscription (features and current prices: flightcockpit.app/pricing). During the public beta the Service is provided free of charge and clearly labeled as beta: features may change, and temporary interruptions are more likely than in a finished product. Your statutory rights remain unaffected.
5. Subscription and Billing
The Pilot subscription is billed monthly in advance via our payment provider Stripe. It renews automatically each month until cancelled. You can cancel at any time in your account's billing portal; cancellation takes effect at the end of the current billing period — no notice periods, no minimum term. After cancellation your account reverts to the Free plan.
Merchant of record for some countries.For purchases from certain countries outside the EU, checkout may be provided by Stripe acting as merchant of record (“Stripe Managed Payments”). Where this applies, it is indicated during checkout: Stripe is then the seller of record for the payment transaction, handles applicable sales taxes, and provides transaction-level payment support, and Stripe's purchase terms apply to that transaction. Your FlightCockpit account, the provision of the Service, the desktop EULA, and these Terms otherwise remain between you and us. Our money-back guarantee (Section 7) applies regardless of the payment route; refunds for such purchases are processed through Stripe. Your statutory rights remain unaffected.
6. Price Changes
If we change the subscription price, we will notify you by email at least one month before the change takes effect. The new price applies from your next billing period after that notice. If you do not agree, you can cancel before the change takes effect; if you continue the subscription afterwards, the new price applies.
7. Right of Withdrawal (EU/EEA Consumers) and Money-Back Guarantee
Withdrawal notice. You have the right to withdraw from a paid subscription contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded (i.e. the day you subscribe). To exercise this right, inform us by an unequivocal statement — an email to hello@flightcockpit.app is sufficient. You may use the model form below, but it is not mandatory. To meet the deadline it is sufficient to send your notice before the 14 days expire.
Effects. If you withdraw, we refund all payments received from you for the subscription without undue delay and no later than 14 days after your notice, using the same means of payment you used. When you subscribe, you request that the subscription starts immediately; if you withdraw after the subscription has started, we may by law deduct a proportionate amount for the period already elapsed. In practice we waive this deduction for your first subscription month and refund it in full — a 14-day money-back guarantee, no questions asked.
Model withdrawal form(complete and return only if you wish to withdraw): “To Batooldev.com, hello@flightcockpit.app — I hereby give notice that I withdraw from my contract for the FlightCockpit Pilot subscription. Ordered on [date], name [your name], email of the account [email], date.”
8. Updates and Conformity
For the duration of your subscription we provide the updates necessary to keep the Service functional, compatible, and secure, free of charge (see also Section 327f of the German Civil Code). The desktop application installs such updates automatically. Your statutory warranty rights for digital products remain unaffected.
9. Acceptable Use
You may not misuse the Service — in particular you may not circumvent license validation or plan limits, disrupt or overload our systems, resell or sublicense access, or use the Service for unlawful purposes. Reverse engineering of the software is governed by the EULA and mandatory law.
10. Availability
We aim for high availability but do not guarantee uninterrupted operation. The Service depends on third-party components we do not control — in particular Microsoft Flight Simulator and its SimConnect interface, your local network, and mobile operating systems. Compatibility with future simulator versions is provided through updates per Section 8.
11. Liability
We are liable without limitation for damages arising from intent or gross negligence, from injury to life, body, or health, and under the German Product Liability Act. In cases of slight negligence we are liable only for the breach of a material contractual obligation (a duty whose fulfilment makes the proper performance of the contract possible in the first place), limited to the foreseeable damage typical for this type of contract. In jurisdictions that do not permit certain limitations of liability, our liability is limited to the maximum extent permitted by law.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that materially breach these Terms; for paid accounts we will warn you first unless the breach makes continued service unreasonable. Statutory termination rights remain unaffected. If we discontinue the paid Service, prepaid amounts for periods not delivered are refunded.
13. Changes to These Terms
We may amend these Terms for good reason — e.g. changes in law, new features, or changes to our payment or hosting providers. For material changes we will notify you by email at least one month before they take effect, highlighting what changed. If you do not agree, you can cancel before the effective date; continuing to use the Service after the effective date constitutes acceptance.
14. Governing Law; Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). These Terms do not limit any mandatory consumer-protection rights applicable in your country of residence. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
15. Final Provisions
Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The contract language is English. Related documents: Privacy Policy, Impressum, and the desktop EULA (shown in the installer).
